Terms of Service

These Terms of Service ("Terms") govern your use of Prongs ("we," "us," or "our"), a writing tool operated by Prongs Publishing, LLC. By accessing or using Prongs at prongspublishing.com, you agree to be bound by these Terms.
1. Account Registration
To use Prongs, you must create an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent.
2. Subscription & Billing
Prongs offers a paid subscription service at $9/month. When you subscribe:
- You authorize us to charge your payment method on a recurring monthly basis.
- Your subscription will automatically renew each month unless you cancel.
- You may cancel your subscription at any time through your account settings or the Stripe billing portal. Cancellation takes effect at the end of your current billing period.
- We do not offer partial refunds for unused portions of a billing period.
3. Free Trial
We offer a 14-day free trial for new users. No credit card is required to start a trial. When your trial expires, you will need to subscribe to continue accessing Prongs features.
4. Your Content
You retain full ownership of all content you create using Prongs, including manuscripts, notes, outlines, and any other written material. We do not claim any intellectual property rights over your content.
You grant us a limited license to store, process, and display your content solely for the purpose of providing the Prongs service to you. This license terminates when you delete your content or close your account.
5. AI Features
Prongs includes an AI assistant powered by Google Vertex AI. When you use AI features:
- Your content may be sent to Google Vertex AI for processing. Google does not use this data for model training under their Vertex AI terms.
- AI-generated suggestions are tools to assist your creative process. You are responsible for reviewing and deciding whether to use any AI output.
- We do not guarantee the accuracy, originality, or quality of AI-generated suggestions.
6. Acceptable Use
You agree not to:
- Use Prongs for any unlawful purpose.
- Attempt to gain unauthorized access to any part of the service.
- Interfere with or disrupt the service or its infrastructure.
- Use automated means to access the service beyond normal use.
- Share your account credentials with others.
7. Service Availability
We strive to keep Prongs available and reliable, but we do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue features with reasonable notice when possible. We are not liable for any downtime or data loss, though we take reasonable measures to prevent both.
8. Data & Privacy
Your use of Prongs is also governed by our Privacy Policy. We take your privacy seriously and do not sell your data or use your content for training AI models.
9. Termination
You may close your account at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the service ceases. We will make reasonable efforts to allow you to export your content before deletion.
10. Limitation of Liability
To the maximum extent permitted by law, Prongs and Prongs Publishing, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or revenue, arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Disclaimer of Warranties
Prongs is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the service. Your continued use of Prongs after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Wisconsin.
